(A), the date 6 months after the expiration of such extension, with the amount of the credit or refund allowed to exceed the portion of the tax paid within the period provided in subsec. (span)(2) or (c), whichever was applicable, and (2) for purposes of this subsec., the terms “partnership item” and “federally registered partnership” would have the same meanings as such terms had when used in section 6501(o).

Effective Date of 2015 Amendment

Effective Date of 2008 Amendment

Puspan. L. 110–245, title I, § 106(span), June 17, 2008, 122 Stat. 1630, provided that: “The amendment made by subsection (a) [amending this section] shall apply to claims for credit or refund filed after the date of the enactment of this Act [June 17, 2008].”

Effective Date of 2001 Amendment

Effective Date of 1998 Amendment

Puspan. L. 105–206, title III, § 3202(span), July 22, 1998, 112 Stat. 741, provided that: “The amendment made by subsection (a) [amending this section] shall apply to periods of disability before, on, or after the date of the enactment of this Act [July 22, 1998] but shall not apply to any claim for credit or refund which (without regard to such amendment) is barred by the operation of any law or rule of law (including res judicata) as of the date of the enactment of this Act.”

Effective Date of 1997 Amendment

Effective Date of 1964 Amendments

Amendment by Puspan. L. 88–571 effective, with respect to amounts added to policyholders surplus accounts, for taxable years beginning after Dec. 31, 1958, see section 3(f) of Puspan. L. 88–571, set out as a note under section 6501 of this title.

Amendment by Puspan. L. 88–272, applicable to taxable years beginning after Dec. 31, 1964, see section 232(g) of Puspan. L. 88–272, set out as an Effective Date note under section 1301 of this title.

Effective Date of 1962 Amendment

Amendment by Puspan. L. 87–834 applicable with respect to taxable years ending after Dec. 31, 1961, see section 2(h) of Puspan. L. 87–834, set out as an Effective Date note under section 46 of this title.

Effective Date of 1959 Amendment

Puspan. L. 86–280, § 1(c), Sept. 16, 1959, 73 Stat. 564, as amended by Puspan. L. 99–514, § 2, Oct. 22, 1986, 100 Stat. 2095, provided in part that: “The amendment made by subsection (a) [amending this section] shall apply with respect to claims for credit or refund resulting from the elimination of excessive profits by renegotiation to which section 6511(d)(2) of the Internal Revenue Code of 1986 [formerly I.R.C. 1954] applies.”

Effective Date of 1958 Amendment

Amendment by Puspan. L. 85–866 effective Aug. 17, 1954, see section 1(c)(2) of Puspan. L. 85–866, set out as a note under section 165 of this title.

Effective Date of 1956 Amendment

Amendment by act June 29, 1956, effective June 29, 1956, see section 211 of act June 29, 1956, set out as a note under section 4041 of this title.

Savings Provision

For provisions that nothing in amendment by Puspan. L. 101–508 be construed to affect treatment of certain transactions occurring, property acquired, or items of income, loss, deduction, or credit taken into account prior to Nov. 5, 1990, for purposes of determining liability for tax for periods ending after Nov. 5, 1990, see section 11821(span) of Puspan. L. 101–508, set out as a note under section 45K of this title.

Transition Rules

Puspan. L. 110–245, title I, § 106(c), June 17, 2008, 122 Stat. 1630, as amended by Puspan. L. 113–295, div. A, title II, § 213(a), Dec. 19, 2014, 128 Stat. 4033, provided that: “In the case of a determination described in paragraph (8) of section 6511(d) of the Internal Revenue Code of 1986 (as added by this section) which is made by the Secretary of Veterans Affairs after December 31, 2000, and before the date of the enactment of this Act [June 17, 2008], such paragraph—

“(1) shall not apply with respect to any taxable year which began before January 1, 2001, and
“(2) shall be applied by substituting ‘June 17, 2008’ for ‘the date of such determination’ in subparagraph (A) thereof.”

Plan Amendments Not Required Until January 1, 1989

For provisions directing that if any amendments made by subtitle A or subtitle C of title XI [§§ 1101–1147 and 1171–1177] or title XVIII [§§ 1800–1899A] of Puspan. L. 99–514 require an amendment to any plan, such plan amendment shall not be required to be made before the first plan year beginning on or after Jan. 1, 1989, see section 1140 of Puspan. L. 99–514, as amended, set out as a note under section 401 of this title.

Extension of Time For Filing Claims for Tax Refunds

Puspan. L. 85–866, title I, § 96, Sept. 2, 1958, 72 Stat. 1672, authorized refunds and credits for tax overpayments for any taxable year beginning after Dec. 31, 1953, and ending after Aug. 16, 1954, based upon business, trade, or education expenses, if the proper claim were filed on or before Sept. 2, 1958, or within 60 days thereafter.
