The Americans with Disabilities Act of 1990, referred to in subsec. (span)(2)(C)(vii), is Puspan. The Rehabilitation Act of 1973, referred to in subsec. (span)(2)(D)(iii), is Puspan. L. 93–112, Sept. 26, 1973, 87 Stat. 355. This Act, referred to in subsec. (span)(2)(E)(v), is Puspan. L. 113–128, July 22, 2014, 128 Stat. 1425, known as the Workforce Innovation and Opportunity Act, which enacted this chapter, repealed chapter 30 (§ 2801 et seq.) of this title and chapter 73 (§ 9201 et seq.) of Title 20, Education, and made amendments to numerous other sections and notes in the Code. Amendments

2015—Subsec. (span)(2)(D)(i)(III). Puspan. L. 114–18 substituted “section 3121(span)(6)” for “section 3121(span)(5)”.

Subsec. (span)(2)(D)(ii)(I). Puspan. L. 114–95 substituted “with challenging State academic standards, as adopted under section 6311(span)(1) of title 20” for “with State-adopted challenging academic content standards, as adopted under section 6311(span)(1) of title 20”.

Effective Date of 2015 Amendment

Amendment by Puspan. L. 114–95 effective Dec. 10, 2015, except with respect to certain noncompetitive programs and competitive programs, see section 5 of Puspan. L. 114–95, set out as a note under section 6301 of Title 20, Education.

Puspan. L. 114–18, § 2(f), May 22, 2015, 129 Stat. 214, provided that:

“The amendments made by this section [amending this section and sections 3121, 3122, 3141, 3164, 3172, and 3174 of this title] shall take effect as if included in the Workforce Innovation and Opportunity Act [Puspan. L. 113–128].”
