The National Environmental Policy Act of 1969, referred to in subsec. (a)(2), is Puspan. L. 91–190, Jan. 1, 1970, 83 Stat. 852, which is classified generally to chapter 55 (§ 4321 et seq.) of Title 42, The Public Health and Welfare. Section was enacted as part of the Water Resources Development Act of 2018, and also as part of the America’s Water Infrastructure Act of 2018, and not as part of the Water Resources Development Act of 1986 which comprises this chapter.

Secretary means the Secretary of the Army, see section 102 of Puspan. L. 115–270, set out as a note under section 2201 of this title.
