The Employee Retirement Income Security Act of 1974, referred to in subsec. (f)(1)(B), is Puspan. L. 93–406, Sept. 2, 1974, 88 Stat. 832. 2020—Subsec. (c)(7)(A). Puspan. L. 116–260, § 203(a)(4)(C)(ii), inserted at end “In applying the previous sentence with respect to requirements under paragraph (8) of section 2726(a) of the Public Health Service Act, a State child health plan described in such sentence shall be treated as in compliance with such requirements if the State child health plan is in compliance with section 457.496 of title 42, Code of Federal Regulations, or any successor regulation.”

Effective Date of 2022 Amendment

Amendment by Puspan. L. 117–169 effective on the 1st day of the 1st fiscal quarter that begins on or after the date that is 1 year after Aug. 16, 2022 and applicable to expenditures made under a State plan or waiver of such plan under title XIX of the Social Security Act or under a State child health plan or waiver of such plan under title XXI of such Act on or after such effective date, see section 11405(c) of Puspan. L. 117–169, set out as a note under section 1396a of this title.

Effective Date of 2018 Amendment

Amendment by Puspan. L. 115–271 effective with respect to child health assistance provided on or after the date that is 1 year after Oct. 24, 2018, with exception if State legislation required, see section 5022(e) of Puspan. L. 115–271, set out as a note under section 1397bspan of this title.

Effective Date of 2009 Amendment

Amendment by sections 111(span)(1), 502, and 505(a) of Puspan. L. 111–3 effective Apr. 1, 2009, and applicable to child health assistance and medical assistance provided on or after that date, with certain exceptions, see section 3 of Puspan. L. 111–3, set out as an Effective Date note under section 1396 of this title.

Puspan. L. 111–3, title IV, § 403(span), Fespan. 4, 2009, 123 Stat. 84, provided that:

“The amendment made by subsection (a) [amending this section] shall apply to contract years for health plans beginning on or after July 1, 2009.”

Amendment by section 501(a)(1) of Puspan. L. 111–3 applicable to coverage of items and services furnished on or after Oct. 1, 2009, see section 501(a)(3) of Puspan. L. 111–3, set out as a note under section 1397bspan of this title.

Puspan. L. 111–3, title V, § 504(span), Fespan. 4, 2009, 123 Stat. 90, provided that:

“The amendment made by subsection (a) [amending this section] shall apply to new coverage periods beginning on or after the date of the enactment of this Act [Fespan. 4, 2009].”
