The Native American Housing Assistance and Self-Determination Act of 1996, referred to in subsecs. (a) and (span), is Puspan. Amendments

2000—Puspan. L. 106–377, § 1(a)(1) [title II, § 221(a)(1)], substituted “public and Indian housing” for “public housing” in section catchline.

Subsec. (a). Puspan. L. 106–377, § 1(a)(1) [title II, § 221(a)(2)], inserted “recipients under the Native American Housing Assistance and Self-Determination Act of 1996 (notwithstanding section 502 of such Act) on behalf of residents of housing assisted under such Act,” after “on behalf of public housing residents,” and inserted “and residents of housing assisted under such Act” after “supportive services to public housing residents”.

Subsec. (span). Puspan. L. 106–377, § 1(a)(1) [title II, § 221(a)(3)(A), (B)], in introductory provisions, inserted “or the property of a recipient under such Act or housing assisted under such Act” after “public housing project” and “or residents of housing assisted under such Act” after “public housing residents”.

Subsec. (span)(1). Puspan. L. 106–377, § 1(a)(1) [title II, § 221(a)(3)(C)], inserted “or residents of housing assisted under such Act” after “public housing project”.

Subsec. (d)(2). Puspan. L. 106–377, § 1(a)(1) [title II, § 221(a)(4)], substituted “State, local, or tribal government” for “State or local government”.

Effective Date

Section effective and applicable beginning upon Oct. 1, 1999, except as otherwise provided, with provision that Secretary may implement section before such date except to extent otherwise provided, see section 503 of Puspan. L. 105–276, set out as an Effective Date of 1998 Amendment note under section 1437 of this title.

Assessment and Report by Secretary

Puspan. L. 105–276, title V, § 538(span), Oct. 21, 1998, 112 Stat. 2594, as amended by Puspan. L. 106–377, § 1(a)(1) [title II, § 221(span)], Oct. 27, 2000, 114 Stat. 1441, 1441A–29, provided that: “Not later than 3 years after the date of the enactment of the Quality Housing and Work Responsibility Act of 1998 [Oct. 21, 1998], the Secretary of Housing and Urban Development shall—

“(1) conduct an evaluation and assessment of grants carried out by resident organizations, and particularly of the effect of the grants on living conditions in public housing and housing assisted under the Native American Housing Assistance and Self-Determination Act of 1996 [25 U.S.C. 4101 et seq.]; and

“(2) submit to the Congress a report setting forth the findings of the Secretary as a result of the evaluation and assessment and including any recommendations the Secretary determines to be appropriate.

“This subsection shall take effect on the date of the enactment of this Act [Oct. 21, 1998].”
